Terms and Conditions for Storage Forest Gate Services
These Terms and Conditions set out the basis on which Storage Forest Gate provides storage, removals, handling and related services. By booking or using any of our services, you agree to be bound by these Terms and Conditions. Please read them carefully before making a booking.
1. Definitions
In these Terms and Conditions, the following expressions shall have the meanings set out below.
Customer means the individual, partnership, company or organisation that requests or purchases services from Storage Forest Gate.
Services means any storage, removal, transport, packing, handling, loading, unloading, or associated service provided by Storage Forest Gate.
Goods means the items, belongings, furniture, equipment or materials that are the subject of the Services.
Contract means the agreement between Storage Forest Gate and the Customer for the provision of Services, incorporating these Terms and Conditions and any written quotation or confirmation issued by Storage Forest Gate.
2. Scope of Services
Storage Forest Gate provides storage and removal services within the United Kingdom, including packing, loading, transportation, unloading and, where agreed, short term or long term storage of Goods. The precise scope of Services for each job will be set out in a quotation or booking confirmation.
Any additional services requested by the Customer that are not specified in the quotation or confirmation may incur extra charges. Storage Forest Gate is under no obligation to provide services beyond those expressly agreed in writing.
3. Booking Process
3.1 Enquiries and quotations
The Customer may request a quotation by providing accurate information about the Goods, access to the property, addresses, dates, and any special requirements. Quotations are based on the information supplied and are subject to change if that information is inaccurate or incomplete.
Unless expressly stated otherwise, quotations are valid for a limited period from the date of issue. Storage Forest Gate reserves the right to amend or withdraw a quotation at any time prior to acceptance by the Customer.
3.2 Acceptance and confirmation
A Contract is formed when Storage Forest Gate confirms the booking in writing, following the Customer’s acceptance of the quotation and compliance with any booking requirements such as deposits. Verbal quotations or availability indications do not constitute a binding Contract.
The Customer must review the booking confirmation carefully and notify Storage Forest Gate without delay if any details are incorrect. If the Customer does not raise an issue prior to the service date, Storage Forest Gate will perform the Services in accordance with the confirmation and will not be liable for any discrepancy caused by incorrect or incomplete information provided by the Customer.
3.3 Changes to bookings
Changes to dates, addresses, access, the volume of Goods, or the scope of Services are subject to availability and may result in additional charges. Any changes must be agreed in writing. Storage Forest Gate will use reasonable efforts to accommodate changes but does not guarantee that changes can be accepted.
4. Customer Responsibilities
The Customer is responsible for ensuring that:
The information provided for quoting and booking is accurate and complete.
Suitable access and parking are available at collection and delivery addresses, including any necessary permits or permissions.
Goods are properly packed and prepared for transport or storage unless packing services have been expressly included in the Contract.
All Goods for removal or storage are clearly identified and are ready at the agreed time.
The Customer or an authorised representative is present during collection and delivery to direct the team and confirm that the Services have been carried out.
Failure by the Customer to meet these responsibilities may result in delays, additional charges, or an inability to complete the Services.
5. Payments and Charges
5.1 Pricing
The charges for Services will be set out in the quotation or booking confirmation. Prices are generally based on factors such as volume or weight of Goods, distance, labour required, access conditions, and duration of storage. Additional services requested or required on the day may incur further charges at the prevailing rates.
5.2 Deposits and prepayments
Storage Forest Gate may require a deposit or full prepayment to secure a booking. The amount and timing of any deposit or prepayment will be stated in the quotation or booking confirmation. If a deposit or prepayment is not received by the due date, Storage Forest Gate may cancel or refuse the booking.
5.3 Payment terms
Unless otherwise agreed in writing, payment for removal and related services is due no later than on the day of service and prior to unloading of Goods at the destination. Payment for storage services is generally payable monthly in advance.
Accepted payment methods will be specified by Storage Forest Gate. The Customer must ensure that cleared funds are available by the due date. If payment is not received on time, Storage Forest Gate may suspend or withhold Services and may exercise a lien over the Goods until all outstanding sums are paid in full.
5.4 Late payments and interest
In the event of late payment, Storage Forest Gate may charge interest on the overdue amount at the statutory rate applicable in the United Kingdom from the due date until payment is received in full. The Customer will also be liable for any reasonable costs incurred in pursuing late payments, including collection or legal costs.
6. Cancellations and Amendments
6.1 Cancellation by the Customer
The Customer may cancel a booking by providing written notice to Storage Forest Gate. Cancellation charges may apply depending on the amount of notice given.
If the Customer cancels more than a reasonable number of working days before the scheduled service date, any deposit paid may be refunded or partially refunded at the discretion of Storage Forest Gate, subject to any non recoverable costs.
If the Customer cancels within a short period before the scheduled service date, including on the day of service, Storage Forest Gate may retain some or all of the deposit and may charge a cancellation fee to cover costs and loss of opportunity.
The specific cancellation periods and fees, where applicable, will be set out in the quotation or booking confirmation or otherwise communicated to the Customer.
6.2 Cancellation or amendment by Storage Forest Gate
Storage Forest Gate reserves the right to cancel or amend a booking if circumstances arise that are beyond its reasonable control, including but not limited to extreme weather, accidents, staff illness, vehicle breakdown, or safety concerns. In such cases, Storage Forest Gate will use reasonable endeavours to offer an alternative date or refund sums paid for Services not provided.
Storage Forest Gate will not be liable for any indirect or consequential loss suffered by the Customer as a result of cancellation or amendment due to circumstances beyond its reasonable control.
7. Goods that Cannot be Transported or Stored
The Customer must not submit for removal or storage any of the following prohibited items:
Explosives, firearms, weapons or ammunition.
Flammable, hazardous, corrosive or toxic materials, including gas cylinders, paints, solvents, chemicals, and fuels.
Perishable goods or items requiring temperature controlled storage.
Illegal items or substances.
Cash, jewellery, precious metals, securities, or other high value items, unless expressly agreed in writing and appropriately insured.
Any item that by its nature or condition is likely to cause damage, infestation or contamination.
If such prohibited items are included without the knowledge of Storage Forest Gate, the Customer will be solely responsible for any resulting loss, damage, cost or claim. Storage Forest Gate may dispose of or remove prohibited items at the Customer’s expense and without liability.
8. Waste and Disposal Regulations
Storage Forest Gate is not a waste carrier and does not operate as a rubbish removal or disposal service unless expressly agreed in writing as an additional service. The Customer is responsible for ensuring that any waste is dealt with lawfully and in accordance with applicable waste regulations in the United Kingdom.
Where Storage Forest Gate agrees to remove unwanted items or waste as a separate service, the Customer confirms that they have the right to dispose of those items. Any waste removal will be subject to additional charges and to compliance with environmental and waste disposal regulations.
The Customer must not request or permit Storage Forest Gate to dispose of items in an unlawful manner, including fly tipping or leaving waste in unauthorised locations. Any costs, fines or liabilities arising from such unlawful disposal, whether instructed by the Customer or caused by misdescription of Goods, will be the responsibility of the Customer.
9. Access, Parking and Property Conditions
The Customer is responsible for ensuring suitable access and parking for the vehicles and staff of Storage Forest Gate at both collection and delivery points. This includes arranging any necessary permits or permissions and ensuring that driveways, hallways and stairways are safe and reasonably clear.
If parking restrictions, long carries, poor access, or other difficulties increase the time or labour required, additional charges may apply. Storage Forest Gate is not responsible for any parking charges or penalties arising from inadequate arrangements where the Customer has failed to provide accurate information or necessary permissions.
10. Liability and Limitations
10.1 General duty of care
Storage Forest Gate will exercise reasonable care and skill in providing the Services and handling the Goods. However, the Customer acknowledges that removal and storage operations carry inherent risks of minor damage or wear.
10.2 Exclusions of liability
Storage Forest Gate will not be liable for any loss or damage arising from:
Inadequate or improper packing by the Customer, including where packing services are not part of the Contract.
Fragile or delicate items not suitably protected or declared.
Normal wear and tear, minor scuffs or scratches, or deterioration arising from storage.
Loss or damage arising from war, terrorism, natural disasters, extreme weather, or other events beyond reasonable control.
Loss of profits, loss of business, loss of opportunity, or any indirect or consequential loss, whether arising in contract, tort or otherwise.
10.3 Limitation of liability amount
Unless a higher value is expressly agreed and additional charges are paid for increased cover, the liability of Storage Forest Gate for loss or damage to Goods, whether arising in contract, negligence or otherwise, shall be limited to a reasonable capped amount per job or per item, as specified in the quotation or booking confirmation or otherwise notified to the Customer.
The Customer is encouraged to arrange appropriate insurance for their Goods, either through a policy arranged by Storage Forest Gate, if offered, or independently.
10.4 Notice of loss or damage
Any apparent loss or damage must be reported to Storage Forest Gate in writing as soon as reasonably possible and, in any event, within a reasonable period after delivery or collection of the Goods from storage. Failure to notify within a reasonable period may affect the ability to investigate and may prejudice any claim.
11. Insurance
Storage Forest Gate may at its discretion offer or arrange insurance on behalf of the Customer for an additional charge, subject to separate terms and conditions. Any such insurance cover, if taken, will be between the Customer and the insurer, and Storage Forest Gate will not be responsible for the insurer’s decisions or the scope of cover.
Where the Customer chooses not to take out such insurance, the Customer accepts that any recovery for loss or damage will be limited to the liability provisions set out in these Terms and Conditions.
12. Lien and Sale of Goods
In the event of non payment of charges, Storage Forest Gate shall have a general lien over the Goods in its possession and may refuse to release them until all sums owed, including storage charges, removal charges, interest and costs, have been paid in full.
If outstanding sums remain unpaid after reasonable notice, Storage Forest Gate may, in accordance with applicable law, sell some or all of the Goods and apply the proceeds to the outstanding debt. Any surplus will be held for the Customer, and the Customer will remain liable for any shortfall.
13. Complaints and Dispute Resolution
Any complaint about the Services should be raised with Storage Forest Gate as soon as possible so that it can be investigated and, where appropriate, resolved. The Customer should provide details of the issue, supporting information, and the outcome sought.
Storage Forest Gate will use reasonable efforts to address complaints promptly and fairly. If a dispute cannot be resolved by informal discussion, the parties may consider using mediation or another form of alternative dispute resolution before resorting to legal proceedings.
14. Data Protection and Privacy
Storage Forest Gate will collect and process personal data relating to the Customer and, where necessary, authorised representatives, for the purposes of providing Services, administering bookings, managing payments, and complying with legal obligations.
Personal data will be handled in accordance with applicable data protection law in the United Kingdom. This may include retaining records for a reasonable period and sharing necessary information with insurers, financial institutions, or regulatory bodies where legally required.
15. Amendments to these Terms
Storage Forest Gate may update or amend these Terms and Conditions from time to time. The version applicable to a particular Contract will be the version in force at the time of booking, unless a subsequent change is required by law. The current version of the Terms and Conditions will be made available on request.
16. Severability
If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court or other competent authority, that provision shall be deemed deleted to the minimum extent necessary and the remaining provisions shall continue in full force and effect.
17. Governing Law and Jurisdiction
These Terms and Conditions, and any Contract between Storage Forest Gate and the Customer, shall be governed by and construed in accordance with the laws of England and Wales.
Any dispute arising out of or in connection with these Terms and Conditions or any Contract shall be subject to the exclusive jurisdiction of the courts of England and Wales, without prejudice to any mandatory statutory rights that may apply to consumers.
By proceeding with a booking or by using the Services of Storage Forest Gate, the Customer acknowledges that they have read, understood and agreed to be bound by these Terms and Conditions.
